How To Protect Your Creativity - Intellectual Property

A whole bunch of things is invented everyday. People use other ideas to create a structure for their inventions or try to make something completely new. Inventions are the product of our mind, and we should be able to obtain benefits when creating something that is useful and new. But, like in all fields, some people will try and commit frauds by taking what is right for others, in other words, stealing one’s intellectual property.

Because of this, many people have lost their invention. You have to consider that it is important to protect your intellectual property. Today, there are certain intellectual property laws that protect people’s ideas from piracy or unauthorized duplication. With this law, your invention or even your design will be protected. So, where can you get your intellectual property protected?

There is a place that helps you with this matter, it’s called the United States Patent and Trademark Office. This is a part of the US government and contributes to the safety of the individuals by protecting their intellectual property. If you have an innovation or some sort of design that needs to be protected, you should register it there. The process is, however, rather complex and you will spend a lot of time with the preparations. In order to improve the whole situation, a lawyer who is specialized in these matters should be hired.

The lawyer will assist you during the process and will explain the whole procedure to you before starting. The process is tricky and hiring a lawyer may prove to be a good solution, since you need somebody who will be there for you at any stage and make sure that everything is correctly done. You will need a pattern of your innovation to validate the fact that you are the true inventor and give it to the lawyer.

The lawyer will then prepare all the legal documents and all the paperwork you have to sign to get your invention patented. By fulfilling all the requirements of the US Patent and Trademark Office, your invention will be examined by the personnel in the USPTO. They will conduct several examinations to your inventions and determine if it is qualified for patenting. They will also search if your idea has already been invented, which is a ground for disqualification.

You have to certify that your invention works well. If everything turns out ok and the USPTO approves that it qualifies, you will be sent to the patent exam. This next exam is also known as the United States Patent and Registration Office registration examination.

If you choose to be alone during the process and represent yourself you can fill a patent pro se. This procedure doesn’t require that people should be represented by a specialized lawyer; but don’t try to do this if you have no knowledge about how the process is done and what it includes.

Being mentally prepared is not enough because registering also means that you will spend a lot of money. Especially on the lawyer fees, which will cost you over US$20, 000. So you have to think good before making this step, otherwise you could lose a lot of money and time. Also, knowing about the system of patenting will help you a lot so make sure you understand everything that is involved in the process.

The process described above is what everybody, who is looking to obtain a patent, should know. Just make sure that you willing and able to spend a big amount of time and money for your patent, otherwise it will prove to be more unprofitable than beneficial.

Just keep one thing in mind, if you think that your invention will be a hit with the public and can generate a lot of income for you, you can consider having your invention patented to protect it from being copied and be under the intellectual property law.
